Study looked into whether drainage system is functioning properly
NEW SMYRNA BEACH, Fla. – After hearing dozens of flooding complaints from residents, New Smyrna Beach city leaders are looking to temporarily stop new development in the Venetian Bay neighborhood.
The city commission is voting Tuesday night on a moratorium that would pause development for commercial and non-single-family homes in Venetian Bay Phase II while the city addresses the flooding concerns.
The complaints have been coming in from residents in the Portofino Reserve subdivision for months.
“The water damage is destroying our streets,” resident Nick Rella told News 6.

Rella showed pictures of his street flooded in the Fall from rainstorms. Then, he showed small cracks that have been forming in his road recently.
He said their stormwater drainage system isn’t working and even more development would overwork it even more.
“Our system never reaches a normal water level, so, it never recovers to the point where we can store a rain storm,” he said.
A letter to the Venetian Bay Homeowners Association from the St. John’s River Water Management District in October found “the system was not functioning.”
New Smyrna Beach city commissioners then jumped in in February, putting the emergency development moratorium in place.
Now, the city is catching up to find a solution.
“The Portofino HOA has had an engineering study done. We’re reviewing those findings,” said Assistant City Manager Ron Neibert.
Neibert said the city’s engineers will run tests next week.
“It may be a design problem, maybe a construction problem, or maybe it was a maintenance issue where the maintenance hasn’t kept up with the needs of the system,” he said.
Neibert said whatever has to be fixed will be on the developer.
The moratorium is technically in effect now under the emergency provision but has to be passed Tuesday night by the city commission to become a real ordinance that can last longer. If passed, it’ll be in effect until the end of June.

A massive great white shark, known to be somewhat of an "artist," paid a visit off the Volusia County coast.
The 13-foot, 3-inch, 1,437-pound shark, nicknamed Breton by the OCEARCH scientists who tagged it, pinged south of New Smyrna Beach at 5:01 p.m. Sunday, March 10. A satellite tag was attached to Breton's dorsal fin in 2020. The tag sends a ping with location information to trackers when it breaks the water's surface.
Breton previously pinged off Jacksonville on Dec. 21, 2023, and Florida's east coast in June and December 2022.
But Breton’s pings between 2020 and 2022 are much more interesting. They connect to show what appears to be the outline of a colossal shark spanning the entire east coast.

Great white shark Breton made 'self portrait' of a shark on OCEARCH tracker
Breton spent a little over two years making a "self-portrait." Its pings between September 2020 and January 2022 connect to show what appears to be the outline of a huge shark, with the tail in Nova Scotia, the body along the east coast and head pointed at Florida's east coast.
"You can track Breton, the white shark that made this self-portrait on the OCEARCH Global Shark Tracker," the research group posted on X, formerly Twitter.

Breton was the first shark tagged during OCEARCH's 2020 expedition in Nova Scotia, the group reported.
At that time the adult shark was 13 feet, 3 inches long and weighed in at a whopping 1,437 pounds.
Breton was named by SeaWorld, an OCEARCH partner, for the people of Cape Breton where it was tagged.

Are there great white sharks in Florida?
Yes. White sharks migrate south when the water gets cold and food sources become scarce up north, according to OCEARCH chief scientist Dr. Bob Hueter.
Think of them as the snowbirds of sharks.
Most of them tend to stay away from the beaches in continental shelf waters, Hueter said.
What does OCEARCH do?
OCEARCH is a nonprofit research organization studying the ocean's giants.
The group studies great white sharks and other keystone species essential for the health of the oceans.
OCEARCH recently finished up its 46th expedition, dubbed Expedition Southeast. It departed from Jacksonville on Nov. 17 and made its final docking in Morehead City, North Carolina on Dec. 15.
During the expeditions, researchers collected previously unattainable data on the animals' migrations, reproductive cycle, genetic status, diet, abundance, and more.
"If we lose the apex predator (sharks) then we lose all our fish and then there are no fish sandwiches for our grandchildren," OCEARCH founder Chris Fischer told the Courier Journal. "That's oversimplified, of course, but the idea is important because many shark species are threatened by overfishing and a demand for shark fins in Asia. Their dwindling numbers jeopardize ocean habitats."
Most shark attacks happen in Florida
There were 69 documented unprovoked shark attacks around the globe in 2023. The U.S. led the world with 36 attacks and Florida again was the state with the most bites at 16.

Since 1992, there have been 1,232 shark bites worldwide, according to data from floridapanhandle.com, with white sharks credited as the top biters.

NEW SMYRNA BEACH, Fla. – A fire broke out early Monday at a popular New Smyrna Beach restaurant.
The fire started just after 1 a.m. Monday at Pappas Drive-In on North Dixie Freeway. Crews say the fire was in the attic area towards the back of the building when they arrived. New Smyrna Beach’s fire chief says it took six engines and 25 crew members to get the fire under control, and hours to knock it down.
“These older buildings are stubborn, heavier timber, heavier conventional lumber layers of roofing material, they are really stubborn to put out,” Fire Chief Shawn Vandermark said. “We’ve been here 8 hours and you can see there’s still spots we’re having to go back and put out just to get them totally extinguished.”
No injuries were reported.
Firefighters with the New Smyrna Beach Fire Department are investigating what caused the fire, but the building is likely a total loss.
Pappas Drive-In opened in 1970 and is known for its famous burgers and fried chicken.
“It was a great place to be and we’re gonna miss not being able to go to it,” said customer Betty Dysterhouse. “And I feel for the owners and all the workers because they worked their buns off and really tried to make people happy.”
Customer Mary Timmerman says she hopes the owners are able to rebuild.
“I am very sad about this, we were just here for breakfast a couple days ago with our granddaughter and it’s just hard to believe and sad,” Timmerman said.
The restaurant also made headlines earlier this year when it was announced that superstar Brad Pitt filmed part of his movie about Formula 1 racing at Pappas.
The movie is scheduled to be released in 2025.

Bystander video and Volusia County Sheriff's Office body camera video shows a man accused of driving on the beach in New Smyrna Beach when the beach access was closed due to high surf.
NEW SMYRNA BEACH, Fla. – A man drove around a closed beach sign and into the rough surf on Florida's New Smyrna Beach on Tuesday, leading to his arrest, according to the Volusia County Sheriff's Office.
The sheriff's office released a bystander video they say shows Jason Brzuszkiewicz, of New York, taking a joyride through the waves when a High Surf Advisory was in effect on Tuesday morning. In the video, the white truck can be seen driving parallel to the shore in the waves, back out and into the surf again.
In body camera video recorded by Volusia County deputies, the driver blamed his truck for not being an amphibious vehicle.
"It’s not my fault the truck don’t surf," he told authorities, adding he thought he was "in England."

His truck's surfing abilities weren't the problem. Deputies said the suspect drove around a closed gate marked "DO NOT ENTER" and accessed the beach. The beach was closed Tuesday because of high surf along Florida's east coast caused by a storm system moving across the peninsula early this week.

High Surf Advisories and Small Craft Advisories remain in effect through Thursday night. Large breaking waves between 5 and 11 feet are possible, along with a high rip current risk for coastal Volusia County, including New Smyrna Beach. Dangerous swimming and surfing conditions are forecast through Friday morning.
According to the arrest report, Brzuszkiewicz is accused of failing to pay the $20 vehicular access fee. He was booked into the Volusia County Branch Jail on a $200 bond.
"Fantastic, that’ll make the Facebook page today," deputies joked as they were loading up the driver.

Sure enough, a few hours later, the not-surfing truck and the accused driver made an appearance on the Volusia County Sheriff’s Office Facebook page.
Social media commenters were quick to point out that New Smyrna Beach is one of the few beaches in Florida open to drivers but "not in the ocean."
Driving on the beach is only legal in Florida in Volusia, Nassau and St. John’s counties when the surf and weather conditions allow.
