Firm says Ormond fuel project is moving forward, county makes new move to stop it

Despite a pledge by an executive of the company that wants to build a fuel distribution and storage facility near Ormond Beach that the operation will be smaller than planned, the county is continuing to explore ways to put a stop to the project.

On Tuesday night, the Volusia County Council voted to consider shifting more power to Ormond Beach in an attempt to block the proposed facility.

Ormond residents and government officials as well as the county government have voiced opposition to the project and are looking for alternative locations and options.

Belvedere Terminals plans to build the facility at 874 Hull Road near U.S. 1. The project has an air quality permit that allows it to dispense over 357 million gallons of fuel and other products each year.

But Belvedere Chief Financial Officer Timothy Schwarz told the News-Journal that the facility will have three main and some ancillary tanks as opposed to the 16 that were originally planned. The facility will still distribute fuel 24 hours a day, with peak hours seeing about four trucks, he said.

District 5 Councilman David Santiago told the crowd gathered on Tuesday that a new law restricts their ability to stop the fuel farm.

Senate Bill 250, signed into law by Gov. Ron DeSantis, limits the county's ability to add "more restrictive or burdensome" land regulations before Oct. 1, 2024, because the county was within 100 miles of where Hurricane Nicole made landfall in 2022.

The land is in the county's jurisdiction, but the city would have more freedom in making changes, Santiago said. So Santiago proposed bringing back an item that would shift control of the land to the city of Ormond Beach. The proposal is expected to come back to the council for a vote.

District 4 Councilman Troy Kent said that the site is not yet under a lease agreement with Belvedere Terminals. It's owned by Florida East Coast Railway.

Kent proposed having the county explore a possible partnership with the city of Ormond Beach in leasing the land. The Council unanimously supported that, and that item will also come back to the County Council for discussion.

Though he ultimately voted in support of looking into a possible lease, District 3 Councilman Danny Robins voiced concern about setting a precedent for the county leasing properties when an issue arises.

Meanwhile, officials at Belvedere Terminals are moving ahead with their plans to launch the site in mid-2025, Schwarz said.

The firm has invested $3 million to $4 million in design and engineering costs for the Ormond Beach location after having preliminary project meetings with Volusia County and Ormond Beach officials in 2022.

Still, the business would consider moving to an alternative location if it met the facility's needs. So far, none have emerged.

He said the facility will bring jobs and tax revenue and will ensure the safety of the community against explosions and leaks.

"There would not be a large-scale explosion," he said.

Schwarz conducted TV interviews this month, including with Spectrum News 13, and made similar comments about building a smaller facility, but they did not allay the fears of people who approached the County Council on Tuesday night and asked for action.

Ormond Beach resident Elena Krafft, who spoke before the Council's vote on Tuesday, showed the County Council a video of her visit to a fuel farm in Tampa over the weekend. She said when she used to live in the area at times she would have to keep her children indoors because of the smell. She urged the county to take concrete action to prevent the Ormond Beach project.

"They told you they have every intention of pursuing this project at Hull Road. Please take their word seriously and be proactive instead of reactive," she said.

The city of Ormond Beach will eliminate its newly created "I-2, Heavy Industrial" zoning district, as agreed by the commission at its meeting on Wednesday, Oct. 4.

As the city continues to prevent Belvedere Terminals' construction of a 16-tank fuel farm at 874 Hull Road, residents have been asking the city to eliminate the zoning designation, which was approved via a land development code amendment on Aug. 1. The zoning district, first identified as a future need in a 2010 Comprehensive Plan Evaluation and Appraisal Report, was created after the city annexed 52 acres owned by Halifax Paving at 860 Hull Road and 1399 Hull Trail.

The Halifax Paving property had a heavy industrial zoning designation from Volusia County, as it was previously unincorporated. The property at 874 Hull Road, owned by the Florida East Coast Railroad, is also unincorporated and zoned heavy industrial. Properties annexed into the city have a legal right to be assigned a land use and zoning that matches what they had in the county.

The city's I-2 zoning district had identified bulk fuel storage as a conditional use. In a Sept. 8 meeting with the Observer, City Attorney Randy Hayes said that the county's heavy industrial zoning definition is "so broad" that bulk fuel storage is considered a permitted use.

"My understanding of what our planning staff was trying to do was, in recognition that these were uses common in the heavy industrial district, you identify them in your code and then as a way to restrict their location, you condition those as a conditional use," Hayes said.

With conditional uses, the property would need to go through the Planning Board and City Commission for approval.

The city and its residents are not only fighting to keep Belvedere from building a fuel farm in Ormond Beach, said resident Robin Magleora at the Oct. 4 meeting. They're fighting to keep a fuel farm away from Volusia County — whose 16 municipalities are passing resolutions of opposition at their government meetings — and they're fighting to keep it out of Florida, she said.

"We are in the forefront," Magleora said. "We are the one that are battling them right now. We have land that is zoned appropriate for them to move in."

The property at 874 Hull Road is under county jurisdiction, and while Halifax Paving's property has been annexed, it hasn't been rezoned to the city's I-2 district.

City Manager Joyce Shanahan said that, based on this, the zoning district could be eliminated.

"I agree, let's delete it," Commissioner Susan Persis said.

The city will bring back an action item for the commission to vote on regarding the zoning district.

This comes after the commission passed two motions stating it would not provide utilities or allow Belvedere to annex into the city at a Sept. 20 meeting.

The St. Petersburg-based company is planning to invest about $750 million in the state by constructing a total of 10 fuel terminals within the next five years. The first of three sites planned to be developed will be in Jacksonville, followed by spurs in Ormond Beach and Ft. Pierce.

Ormond Beach is also working to create an interlocal agreement establishing a joint planning and municipal service area for zoning and land uses involving unincorporated lands that share a boundary with the city.

But that's a long process, Shanahan said. Establishing the current interlocal boundary agreement with the county for the North U.S. 1 corridor took four years.

Hayes said the city could expand the footprint of the North U.S. 1 corridor interlocal boundary agreement, or create a new one. It's a longterm project with potential legal issues that need to be navigated through, he said.

"It's not going to be a quick process or a quick fix, and it's not something that we're going to be working on forward right now because there are some things that we've got to push forward in front of that," Hayes said.

ORMOND BEACH, Fla. — Dozens of Ormond Beach residents are preparing to attend Wednesday night’s special Volusia County council meeting on a proposed fuel terminal.

What You Need To Know

On Aug. 1, the Florida Department of Environmental Protection issued a final air construction permit to Belvedere Terminals Company, LLC. According to the permit, the Ormond Beach Terminal will contain 16 storage tanks, holding 20.4 million gallons of fuel. Six of the tanks are set to be 40 feet tall.

The company is also planning fuel terminal sites in Jacksonville and Ft. Pierce as part of a multi-site fuel distribution system. The company said the system will “offer Floridians safer, lower cost and more reliable delivery of gasoline, diesel and jet fuel.”

Last week, hundreds of residents took to the Ormond Beach City Commission meeting to speak in opposition of the fuel terminal. They raised safety, traffic, health and environmental concerns. Ultimately, the Ormond Beach City Commission unanimously voted to appeal the terminal’s construction permit issued by FDEP.

Residents are hoping for a similar outcome at the special Volusia County council meeting Wednesday. The council agreed to hold the meeting to gain more information about the fuel terminal before making a decision about whether or not they also plan to appeal the FDEP construction permit.

One Ormond Beach neighborhood is particularly concerned about the terminal’s location. Bear Creek Village is a retirement community located less than a mile from the proposed site. More than 1,300 people live in the community.

For Bear Creek resident Gary Biermann, the site’s proximity to his neighborhood is alarming.

“It’s just not a safe place,” Biermann said. “It’s far too close to residential areas for it to be put here. It makes no sense to me.”

Biermann said the site is also close to the Ormond Beach Municipal Airport, two other residential communities, multiple business parks and the Ormond Beach Sports Complex.

Before retiring, Biermann worked as a manager of site security and safety for Lockheed Martin. He managed a team that conducted site assessments for refineries, ports and fuel tank farms. His insight gives him pause about the tank farm now being proposed near his home.

“You typically want to build these far away from any critical infrastructure and any people because they’re dangerous,” Biermann said.

Biermann hopes their voices will be heard.

“It’s going to be a bus load of people coming from Bear Creek and a whole bunch of car loads full,” he said. “They’ll get to hear from us directly about what our concerns are and we hope to be heard.”

More than 50 Bear Creek residents are already set to attend the meeting — which is scheduled for 5:30 p.m. The meeting will be held in the County Council Chambers located on the second floor of the Thomas C. Kelly Administration Center at 123 W. Indiana Ave. in DeLand. Officials said the public is welcome to attend and the meeting will be live-streamed.

In a previous statement to Spectrum News 13, Belvedere Terminals COO Mike Benedetto said:

“The safety and wellbeing of Ormond Beach residents is our top concern. We are still in the early stages of planning, and we will work with City and State officials — since they maintain public roads — to make any needed improvements around our proposed facility. Additionally, we are already under contract with one of the top fire safety firms in the country and they are designing this facility to meet or exceed all requirements from the American Petroleum Institute and National Fire Protection Association. Residents became aware in early August when the Florida Department of Environmental Protection issued a final air permit to the company behind the project, Belvedere Terminals Company, LLC.

Magleora was stunned when she learned of plans for 60 vacant acres west of U.S. 1, near the railroad tracks off Hull Road. Belvedere Terminals Company is creating a fuel distribution system with several sites in Florida, including an Ormond Beach terminal. The proposed terminal would have an above-ground tank farm of 16 tanks holding up to 20 million gallons of fuel. Some of the tanks would be 40 feet tall. In addition, it will have multiple loading bays to transfer fuel from trains to tanker trucks for distribution.

“The catastrophic ramifications of this type of facility holding this much fuel. The loss of life to the citizens in the area,” Magleora said.

The proposed site is close to several residential neighborhoods, less than a mile from the city's sports complex, constantly busy with children and families and a mile or so from the municipal airport where student pilots train.

Not only are citizens speaking out, they have started a Facebook page opposing the project and a petition drive that thousands have signed already.

“There's just too many homes to put heavy industrial uses out there,” Ormond Beach Mayor Bill Partington said.

Partington shared a picture of a commission meeting last week–standing room only with all speakers and leaders against the fuel farm – but the mayor says the site, which is actually in the county, not the city, is zoned heavy industrial, so leaders are researching what other grounds they have to fight it. The mayor says traffic is certainly a huge concern.

“They're talking anywhere from four to seven tanker trucks an hour coming into U.S. 1 or Harmony Road and then going back out to 95,” he said.

The city will file an appeal with the Florida Department of Environmental Protection which issued a final air permit to Belvedere on Aug. 1. Volusia County leaders are meeting Wednesday to decide whether they, too, will take action.

We reached out to Belvedere Terminals. The company's COO Mike Benedetto responded, “The safety and wellbeing of Ormond Beach residents is our top concern. We are still in the early stages of planning, and we will work with City and State officials - since they maintain public roads - to make any needed improvements around our proposed facility. Additionally, we are already under contract with one of the top fire safety firms in the country and they are designing this facility to meet or exceed all requirements from the American Petroleum Institute and National Fire Protection Association. We never want there to be any danger to our employees on the facility or anyone outside of it, and in the unlikely event that there is an emergency, we will be fully prepared."

A proposed fuel storage facility in Ormond Beach has residents not only outraged but determined to stop the project in its tracks.

The most recent pushback comes from a local beverage distributor, who, with the help of the city, filed a petition challenging the company's air quality permit.

This is only more proof that the fight continues to stop a major fuel farm from coming to Ormond Beach.

"We're committed to fight this Volusia County project at every turn," said Ormond Beach Mayor Bill Partington.

Partington said the city has teamed up with S.R. Perrott, a local beverage distributor.

"We're supporting the request to have the air permit thrown out," Partington said.

S.R. Perrot, with the help of the city, submitted a petition challenging the air quality permit issued by the Florida Department of Environmental Protection. According to the mayor, these permits are required for some new constructions.

"It is for the company to be able to show that they are not going to decrease the air quality in the surrounding area," he added.

However, according to the petition submitted, the adverse effects of this fuel farm have not been fully studied, which is why they're challenging the air permit. The petition also argues some legal requirements weren't met.

Residents became aware of this project in August, when the final air permit was filed to Belvedere Terminals, but this petition now argues the company didn't provide adequate public notice.

The notice, according to the mayor, is that the company didn't print it in a publication with large circulation.

And residents agree.

"So we really feel blindsided," said Eleana Krafft, an Ormond Beach resident. "We had no time to come up with any arguments against it and how unsafe it is."

Now, they're waiting to hear back on the petition.

"We're expecting maybe two to three weeks, they can either require them to go back through the application process for an air permit, or they can ask them to refer it to an administrative law judge," Partington said. "Either way, it's going to delay it for months."
